These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Redstone Build (“Company,” “we,” “us,” or “our”), a licensed Virginia Class A Contractor located in Tysons Corner, Virginia. These Terms govern your access to and use of the website located at https://redstonebuild.com (the “Site”), including any content, features, contact forms, and services offered through the Site.

By accessing, browsing, or using the Site in any manner, or by submitting any information through the Site (including requests for a free lot evaluation), you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site.

We may update these Terms from time to time. The “Effective Date” at the top indicates the most recent revision. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

2. About Redstone Build and the Site

Redstone Build is a licensed Virginia Class A Contractor specializing in custom home construction on client-owned lots in Northern Virginia. We serve Loudoun County, Fairfax County, Prince William County, Fauquier County, Stafford County, Warren County, and Clarke County. Our principal place of business is in Tysons Corner, Virginia.

The Site is an informational and lead-generation website. It provides general information about our build-on-your-lot services, process, service areas, and allows visitors to request a free lot evaluation or contact us. The Site does not offer online purchasing, user accounts, file uploads, or interactive project management tools. Any exchange of plans, documents, or detailed project files occurs only after we contact you and only through mutually agreed channels outside the Site.

3. Eligibility

The Site is intended solely for individuals who are at least eighteen (18) years of age and who are capable of forming a binding contract under applicable law. By using the Site or submitting any form, you represent and warrant that you are at least 18 years old and that the information you provide is accurate and complete. We do not knowingly collect information from or market to individuals under 18. If we learn that we have received information from a minor, we will delete it.

This information is typically limited to your name, email address, phone number, and any details about your property or project that you choose to share. You are solely responsible for the accuracy and content of any information you submit.

By submitting information, you grant us a non-exclusive, royalty-free, worldwide license to use that information solely for the purpose of responding to your inquiry, evaluating your lot (if requested), and communicating with you about our services. We do not claim ownership of your project ideas or property information.

File exchange (plans, surveys, photos, contracts, etc.) will occur only after we have contacted you and only through channels mutually agreed upon outside the Site. The Site itself does not support document uploads or file sharing.

6. Intellectual Property

The Site and all of its content, features, and functionality—including but not limited to text, graphics, logos, images, photographs of completed homes, design concepts, layout, and software—are owned by Redstone Build or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, publicly display, or create derivative works from any content on the Site without our prior written permission, except for the limited personal viewing rights granted under these Terms. All trademarks, service marks, and trade names appearing on the Site are the property of their respective owners.

7. Prohibited Conduct

You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
• Submit false, misleading, or fraudulent information through any form on the Site.
• Attempt to gain unauthorized access to the Site, its servers, or any related systems or networks.

8.2 Estimates, Timelines, Costs, and Process Descriptions Are Approximate

Any information on the Site regarding costs, pricing ranges, timelines, construction process steps, materials, warranties, or project examples is provided for general informational purposes only and is approximate. Actual costs, schedules, and outcomes vary significantly based on site conditions, design choices, material selections, permitting requirements, weather, labor availability, and many other factors. Nothing on the Site constitutes a firm quote, guarantee, or warranty of price, schedule, or performance.

8.3 Not Professional Advice

Content on the Site is not intended as architectural, engineering, legal, financial, or construction advice. You should not rely on Site content as a substitute for professional advice tailored to your specific situation. Always consult qualified professionals (architects, engineers, attorneys, surveyors, etc.) and obtain site-specific evaluations before making decisions about purchasing land, designing, or building a home.

8.4 Separate Written Agreements Govern All Projects

Any actual custom home project will be governed exclusively by a separate, detailed written contract signed by both parties. That contract (and any related design or other agreements) will contain the complete terms, conditions, pricing, scope of work, warranties, schedules, and other provisions. In the event of any conflict between these Terms or Site content and a signed project agreement, the signed project agreement will control.

8.5 Site Content “As Is”

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATION OR WARRANTY REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REDSTONE BUILD, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, ANY CONTENT ON THE SITE, OR ANY COMMUNICATIONS INITIATED THROUGH THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless Redstone Build and its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms; (c) any information or content you submit through the Site; or (d) your violation of any rights of a third party.

11. Third-Party Links and Services

The Site may contain links to third-party websites, social media platforms, or services (including X/Twitter and others). These links are provided for convenience only. We do not control and are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk and subject to their respective terms and policies.

By using the Site, you consent to the collection, use, and disclosure of information as described in the Privacy Policy. We do not sell or share customer contact information for third-party marketing purposes.

13. Termination and Suspension

We reserve the right, in our sole discretion, to suspend or terminate your access to the Site (or any portion thereof) at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, indemnification, and governing law) will continue in effect.

14. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to these Terms, the Site, or your use of the Site shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles.

You and Redstone Build agree that any legal action or proceeding arising under these Terms or relating to the Site shall be brought exclusively in the state or federal courts located in Fairfax County, Virginia. You hereby consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

Notwithstanding the foregoing, either party may seek temporary or preliminary injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information. Nothing in these Terms requires arbitration; disputes will be resolved in the courts specified above.

15. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and Redstone Build concerning the Site and supersede all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and us with respect to the Site.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

Waiver. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this provision is void.

Headings. Section headings are for convenience only and have no legal or contractual effect.
